NOTICE OF PROPOSED DECISION

The Colorado Division of Reclamation, Mining and Safety proposes to Approve Technical Revision Application No. 87 (TR-87) for the Colowyo Coal Mine (Permit No. C-1981-019), submitted by Colowyo Coal Company L.P.. The Colowyo Coal Company, LP (Colowyo) has submitted a Technical Revision for the Colowyo Mine to include new sediment control devices and update the reclamation blocks in the East Pit of the mine. This revision includes the addition of five stock ponds in the Prospect watershed of the East Pit and changes the reclamation blocks to address concerns raised in the Division’s 2010 Midterm Review (MT-06). The revision includes updated hydrologic monitoring for the Prospect Watershed in the East Pit. There is no proposed change to the mine’s disturbance boundary or permit boundary with this revision. There will not be any change to the mine’s reclamation liability as a result of this revision.



The Colowyo Coal Mine is a surface coal mine located in Moffat County, approximately 28 miles south of Craig, Colorado. Coal interest is Federal, and the surface affected is Federal, state and private land. The permit area encompasses approximately 12,250.95 acres.

This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34 33 101, et seq., C.R.S., and the regulations promulgated thereunder.



Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within ten (10) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.
