Layne Howard, 25, of Vanderwagen, New Mexico, was arrested on charges of driving under the influence of alcohol, driving a motor vehicle when privilege to drive/license was restrained for express consent, careless driving and speeding. Howard was stopped for speeding, but he had also struck another vehicle pulling out of the west Kum and Go parking lot. The vehicle that he struck pulled up in front of him after Howard was pulled over. One officer conducted a traffic accident investigation with the driver of the other vehicle while another officer evaluated Howard. “During my initial contact with Howard, I noticed that his speech was slurred and his eyes were bloodshot and watery in appearance,” the Craig Police Department affidavit reads. “His eyelids were droopy.” Howard denied drinking alcohol, refused roadside evaluation and insisted he was being set up. After being placed under arrest, Howard began to hit his head against the inside of the patrol car, and as a result of his “disruptive behavior” was booked into Moffat County Jail.
