ACET: Distribution took place near school, church

— The All Crimes Enforcement Team arrested a 45-year-old Craig man Thursday for allegedly distributing drugs near a preschool and day care center.

Jerry David Flannery, who has a previous drug conviction and another drug case pending in Moffat County Court, was arrested on suspicion of distribution of a Schedule 2 controlled substance, a Class 2 felony; possession of a Schedule 1 controlled substance, a Class 3 felony; and possession of drug paraphernalia, a petty offense.

Flannery was booked into Moffat County Jail and appeared Friday in county court, where a judge set his bond at $100,000.



The 14th Judicial District Attorney’s Office asked the judge to set bond at $150,000.

Flannery had not posted bond as of Friday afternoon.



ACET, participating in a joint investigation with the Craig Police Department and the Moffat County Sheriff’s Office, served a search warrant at a residence in the 700 block of School Street on Thursday night.

The residence is next door to Sunrise Kids LLC Preschool & Child Care.

“ACET investigators applied for the search warrant after an approximate four-month investigation into distribution of methamphetamine,” the agency reported in a news release Friday.

“ACET investigators investigate numerous cases at any given time but devoted much of their time to this case as the suspect : was distributing next door to the Sunrise preschool and day care center : which was a top priority for ACET.”

The residence also is near St. Michael Catholic Church, located at 678 School St.

During the search, ACET allegedly seized about 60 grams of methamphetamine, nine grams of psicolycibin mushrooms, drug paraphernalia and items consistent with distribution of methamphetamine, the task force reported.

“This is another example of a collaborative effort between concerned citizens and local law enforcement agencies working together,” ACET stated in the news release.

According to court records, official charges have not yet been filed against Flannery.

However, ACET reported it anticipates the District Attorney’s Office filing more charges against Flannery than what he was originally arrested for, including a special offender charge for distributing within 1,000 feet of a school.

Thursday wasn’t Flannery’s first encounter with law enforcement.

Court records indicate he pleaded guilty in 2004 to possession of a Schedule 2 controlled substance more than 1 gram, a Class 4 felony.

He also was arrested in February at a Craig hotel, again by ACET.

In that case, he is charged with distribution of a Schedule 2 controlled substance and possession with intent to distribute a Schedule 2 controlled substance, Class 2 felonies, and tampering with evidence, a Class 6 felony.

He is scheduled to appear for an arraignment hearing Aug. 19 in connection with the February case.
