I think Brad and Laurie have a good point. I know first hand that if you dog chases the deer off your property you can get a ticket from DOW and/or city for harassing wild life. I know a guy who uses a paintball gun to keep them off his property and that I hear can land you in jail. I for one feel sorry for their dog as I know that the deer are no longer afraid of dogs in town and many aren't afraid of humans, adults or kids. It's only a mattr of time when a kid is going to get ruffed up pretty bad.

If it were a mountain lion or a bear in town I am sure the DOW would come do something about it because they are consider “dangerous”. Will it take a child gettig gored before some of these large bucks are considerred dangerous? Heck the city thinks a dog wandering the streets is dangerous and expend thousands of dollars a year to make sure they aren't a nusense. I personally have about seven or eight bucks that live in my side yard and I am sure its only a matter of time before my snoopy dog is roughed up too.

Thanks craiggirl for the information. I think that the Editorial Board is off he mark on this one. The Loopers already paid for that property when they bought the hotel. The company that is laying claim to it just found out that the stairs were on their property after 60 years? Are you serious? The simple fact that both properties have changed hands a bunch of times should eliminate the development company's claim to it. Not until it became a money issue did they ever stake a claim. The Loopers have been paying property taxes on that piece of ground and the improvements on it since they bought it. And the previous owners have paid taxes on it for the last 55 years. The county accessors office has always included that three feet on their assessment of value and the owners of that hotel have paid taxes for years for the improvements on that ground. Maybe the development company should have to pay them back for the taxes attributed to that stairway on the property (plus interest over 60 years). If this was a simply annuity and the taxes generated from that stairways was $25 per year (in 1949) and increased at a rate of 5% per year, the TIme Value of the taxes paid on that stair way over the last 60 years would amount to about about $100,000 (based on a 9% annual rate of return which is far below the average market rate of return over the same time period) that the owners of the hotel have paid out in taxes. So the developer should have to either pay back taxes on the property or reimburse the owner for the taxes they paid on behalf of the developer over the last 60 years.

Anyway you slice it, the big company has “overlooked” a worthless strip of ground for a long time because it suited them. Now they see they could make a few bucks and all of a sudden the fact that the Elk Run Inn has a stairway on the property makes them upset. I hope the courts tell the big dogs to stick it. They screwed up, they should have to pay the price.

Didn't a bunch of people without law degrees tell the city they shouldn't prosecute this back before the City Coucnil decided to make an “eample” out of Mr. Raina? I think they said that this would be a waste of money and time…….I wonder if this was in the budget?

I disagree dogfan. I think this is money well spent informing the community about what it did in 2008. It also recognizes individual and group achievement in addition to providing information on how it did in 2008.

Thank you for the annual report. I just wanted to give you a heads up that who ever built the spread sheet for the presentation of the financials on pages 4 and 5 mixed up the year columns and what the change would be between 2007 and 2008.

The publications shows that TMH had decreases in Total Services Provided between 2007 and 2008 when in actuallity the had increases of $2.9 millioin and an increase in $1.9 million in Net Patient Revenue. TMH should be proud to let the community know that they increased the amount of Charity Care they provided by $300K last year and only had marginal increases in Contractual Adjustments, but the financials presented show the opposite of that.

Likewise, TMH had a total increase not a decrease in Total Revenue of $2 million even after the building impairment and only showed a marginal decrease in net income of $10K.

I think it would be a good idea if the publication company made the appropriate corrections to the financial presentation and reprint this document. It will be around for years and does not reflect what the hospital did in 2008. The CFO did a good job of explaining the financials in his narrative but their presentation undoes his explainations due to their error in printing.

Actually prosecuters, judges, police officers, state officials, federal agents, etc etc etc pick and choose who they prosecute every day all over this country. The voters and the constitution actually afford these people the right to determin who, what, when, where, why, and how things get prosecuted. Just because a law is broken does not mean that person will or should get prosecuted (i.e. you get pulled over for doing five over and the officer lets you off…..you broke the law right? The law says you should get a ticket for $100 bucks but you don't. How come? Becaue the officer chose not to waste your time and his by writing you up for something so stupid and trivial). The same goes with Mr. Raina. The city has already spent twice what Raina spent to file charges against him. They have and will continue to wast time and money and in the end yes Mr. Raina will pay a fine. And he will be fined not because he broke the law, but because he didn't understand the system. I would be willing to bet, if you really wanted to get technicall, every councilman spent more than the allowed $500 bucks. The only difference is, they were just savy enough not to report it, as hundred and hundred of violators of this same crime do every year during elections. This is one of those wink, wink, nudge, nudge rules and Mr. Raina didn't understand the process, that's the only difference.

So I am sorry that you don't understand the system and think that it operates differently and I hope the next time you jay-walk, do five over on your way home from work, or committ some other trivial crime of little significants that you get the book thrown at you.

When are they going to outlaw Karate and Kung Fu? That's what I want to know. I mean the purpose of it is for self defense right? But how many use those skills to kill and injur people and not what it was originally intended for? Will they make it illegal to teach Karate one day? I mean people don't kill people, Karate kills people right? It's all Karates fault when some guy beats up another guy right?

Sounds @$$enine doesn't it? But its the same argument people like President Obama have about guns. Lets outlaw the gun and people will quite killing people right? More people are killed each year because of drunk drivign than gun crimes, so why aren't we outlawing cars and alcohol? Oh thats right almost eveyone drives and who doesn't appreciate a good stiff drink now and then. It's illegal to drink and drive (just like it's illegal to kill someone with a gun) but people have their own free will and will choose to do what they want. Let the penalty be swift and with out mercy in the cases of drunk driving and crimes commited with firearms and you will see a huge decrease in their incidences.

You may not care about someone elses right to own guns legally, but once they get done with guns what is next. Eventually they will want to take away something that is of importance to John-Q-public and no one will stand with him because he didn't stand with others and say that personall accountability of those committing the crimes must take presedence over an inanimate object.

More people will die tomorrow from skin cancer than all the people who will die from Swine Flu over the next year. More people will be killed by a drunk driver tomorrow along than will die from swine flu in the next five years. More people died from West Nile Virus than will die from Swine Flu. More people will die from complications related to diabets tomorrow than will die from all flu type illness in the next year.

We get all worked up about things like this and dump billions of dollars for what? How many people are scared of the damaging effects of the sun on their skin, a drunk behind the wheel, eating junk food that will clog your arteries, or getting bit by a mosquito? All of these things are more likely to kill you than the swine flu, but we get all worked up because someone died from the flu. Someone dies from the flu all the time, if we get all worked up everytime someone gets sick and dies then we should all just become hermits and never leave our house.

I think most people hope that area of town doesn't become blighted when the hospital leaves. If you read closely you will see that it was the VNA who is spearheading this effort. I think it will cost more money than most of those organizations have to remodel and use it in a constructive way. I have also heard it would cost a lot to knock down and a lot more to remodel since there are so many things wrong with it. When the hospital was looking at moving (and thank God they are moving) they showed us all how bad the place was. They showed us old boilers, asbestos, broken duct work, and a leaky roof. Just to fix those items I would guess that it would be hundreds of thousands of dollars.

I hope this money can be used to get a better idea of what needs to be done with the old girl and hopefully point them in the right direction on how to make it happen.

Remember that we all have rights under the constitution and those rights are inalienable until they infringe on the rights of others. A person can do what ever they want with their land unit that individual or organization begins creating a bi-product that contaminates another person's water, air, land, etc. Other junk yards have been required to dismantle vehcilce and store parts in areas that have concrette barriers with curbing that prevents water from washing contaminates into the soil and water. Wrecking yards right here in colorado have been fined and put out of business for willfully violating laws that state how a wrecking yard must be operated. A business is subject to laws. A resturaunt can't serve spoiled food because it makes people sick. Likewise, a wrecking yard can't contaminate the environment because it will make people and animals sick. I think these types of businesses need to get cleaned up or we as a community need to get them put out of business. We all have a responsibility to keep the environment clean. I don't think anyone should be able to hide behind private property rights and get away with having all those chemicals get washed into the river.
