Eduardo Capote took the stand Monday in his own defense. Capote is charged with felony second-degree assault and one count of misdemeanor third-degree assault, and his brother, David Capote, is charged with one count of misdemeanor third-degree assault, stemming from a fight that occurred in January 2009. Richard Lopez was seriously injured in the fight and later died from injuries sustained in the altercation.
