David Capote sits in the Routt County Courtroom Monday afternoon while his brother, Eduardo Capote, recalls the events from the night Richard Lopez was seriously injured in a fight. Lopez later died because of injuries sustained in the fight. David is facing one count of misdemeanor third-degree assault in the case, and his brother, Eduardo, is charged with felony second-degree assault and one count of misdemeanor third-degree assault.
