Scott reaches deal with district attorney

Pleads guilty to a Class 5 felony

Derik Scott appeared Wednesday in Moffat County District Court and pleaded guilty to criminal attempt to commit second-degree assault, a Class 5 felony.

Wednesday's plea was part of a deal reached with the 14th Judicial District Attorney's Office.

Scott, 24, of Craig, was charged in district court with two counts of second-degree assault, a Class 4 felony, and one count of violating the conditions of a bail bond, a Class 6 felony.

Scott also faced two counts of sentence enhancers, including one count of committing a violent crime with the use of a weapon and one count of committing a violent crime causing serious bodily injury.

Those charges have been dropped.

In addition one of Scott's four pending cases in Moffat County Court has been dismissed as a result of the deal.

By pleading guilty to a Class 5 felony Scott faces anywhere between one and three years in prison, and two years of mandatory parole, according to the presumptive range defined by Colorado Revised Statutes.

Under exceptional circumstances a Class 5 felony conviction could result in as little as six months to as long as six years in prison.

Matt Tjosvold, Moffat County chief deputy district attorney, did not recommend a sentencing punishment when he presented the deal Wednesday in district court.

The sentencing is considered "open" and will be determined by Chief Judge Michael O'Hara during Scott's next court date, scheduled for 3:30 p.m. Feb. 21.

Though one of Scott's cases was dismissed as a result of the deal, he still faces sentencing in three separate cases in county court.

Scott pleaded guilty to misdemeanor charges in those cases, including two counts of violating a protection order and one count of revocation of probation.

Scott is scheduled to appear for sentencing on those charges at 2 p.m. Feb. 26 in county court.
