Prosecutors file felony charges against Craig man
February 26, 2011
A 24-year-old Craig man has been charged with four felonies relating to an alleged assault.
Stephen Gee Essex Martin was charged Feb. 23 with first-degree burglary, a Class 3 felony, and second-degree assault, a Class 4 felony.
He was also charged with first-degree criminal trespassing and stalking, both Class 5 felonies, and harassment, a misdemeanor.
Martin is set for an arraignment hearing at 8:30 a.m. Tuesday in Moffat County District Court.
The charges stem from an alleged assault Feb. 21.
An alleged victim told police he received text messages about the girl he was dating, and also text messages that were threatening, from an unknown number the day before the alleged attack, according to court records.
A police officer later called the suspicious number and Martin allegedly answered the phone.
The day of the alleged assault, another message was sent, allegedly asking the victim to fight.
The alleged victim texted back that he didn't want to fight, but later received a text message saying he should come outside; he then heard a knock on his door, according to court records.
Martin allegedly was outside of the apartment with another person and assaulted the victim, according to court records.
Martin met with a police officer that afternoon.
He allegedly told the officer that he had been to the apartment, stepped into the residence at one point, and had touched the victim with his finger. But, he denied assaulting the victim, according to court records.
Martin was taken into custody without incident.
Records also indicate Martin faces a second-degree introducing contraband charge.
Information was not available Friday regarding the contraband charge.
