Craig man reaches plea agreement in child porn case

A 39-year-old Craig man arrested in December 2011 in Moffat County on child pornography charges and again in March on suspicion of sexual assault on a child has reached a plea agreement with the 14th Judicial District Attorney's Office resolving both cases.

The suspect's name is being withheld in accordance with newspaper policy not to release the identities of suspected sexual offenders unless convicted.

Prosecutor Han Ng said stemming from the December 2011 arrest the suspect pleaded guilty to possession of sexually exploitative material, a Class 3 felony, and possession of child pornography, a Class 4 felony, with a stipulated sentence of 12 years in prison.

In relation to the charges filed in March, Ng said the suspect pleaded guilty to solicitation to commit sexual assault on a child by a person in a position of trust, a Class 4 felony, with a stipulated sentence of five years to life probation.

The suspect is scheduled for sentencing at 1:30 p.m. Aug. 7 in Moffat County District Court.

"I think that as a matter of law the sentences merge because of how he was charged," Ng said. "But be that as it may, a Class 3 felony carries a maximum sentence of 12 years, and we're stipulating to 12 years in (the Colorado Department of Corrections)."

The two sentences will run consecutively and Ng said after the prison term the suspect will have to register as a sex offender for the rest of his life regardless of his probation status.

Craig Police Commander Bill Leonard said the plea agreement closes one of the most difficult cases he's seen as a member of the police department.

"This was probably the worst child pornography case we've ever handled," Leonard said. "There were a lot of just horrific images, images that had an effect on the investigators involved with the case."

In addition to the charges he faced in Moffat County, the suspect also was facing four charges of sexual assault on a child in Fremont County stemming from an investigation predating his December 2011 arrest.

Ng said those charges will be dismissed after the suspect is sentenced in Moffat County as part of the plea agreement's disposition.

Officials from the 11th Judicial District Attorney's Office in Fremont County were not available Friday for comment.
