Former Craig Police Detective Ken Johnson reached a plea agreement Tuesday with the 14th Judicial District Attorney’s Office.

Johnson, who

was also a member of the All Crimes Enforcement Team, was charged with attempting to influence a public servant, a Class 4 felony, and accessory to crime and embezzlement of public property, Class 5 felonies.

Johnson pleaded guilty in Moffat County District Court to Count 1, attempting to influence a public servant.

The other felony charges are to be dismissed.

A sentencing hearing was set for June 8.

As part of the plea agreement, Johnson cannot be sentenced to more than 60 days in jail. Terms of probation have not been finalized.

“We think the plea is a benefit to the community,” said Jeremy Snow, chief deputy district attorney for the 14th Judicial District Attorney’s Office. “In entering this plea, he gives up his right to appeal any findings of a jury trial, which ultimately means that by entering a plea, this ensures finality.

“The community isn’t going to be drug through this two or three times, possibly. Therefore by entering finality we can move forward and put this behind us.”

According to court records, Johnson “unlawfully and feloniously attempted to influence” Craig Police Chief Walt Vanatta, and commanders Jerry DeLong and Bill Leonard during an internal investigation.

Prosecutors allege Johnson’s actions were by “means of deceit” with the intent to affect decisions or actions.

Johnson resigned from the Craig Police Department in September 2009, and was arrested later that month and charged.

The charges stem from Johnson’s alleged relationship with Craig resident Tausha Merwin, who has past convictions for drug distribution and possession.

Johnson allegedly provided Merwin with information about ongoing law enforcement investigations and helped her violate probation during his time as a law enforcement officer.

He also allegedly gave her a laptop computer and other equipment used by ACET.

Judge Shelley Hill originally set the case for a jury trial beginning May 24, but that trial has been vacated.

Merwin, a Craig resident, is also charged with attempting to influence a public servant, a Class 4 felony.

She pleaded not guilty Feb. 17.

Merwin is scheduled appear July 12 in district court for a jury trial. The trial is expected to take four days.

According to court records, Merwin allegedly lied to police officials about her alleged relationship with Johnson.

This is totally insane. Why bother taking it to court? Why not hire him back on with law enforcement? I'm sure he won't break the law again. GOOD LORD! Get a grip and do something to these people that are breaking the law and putting others in jeopardy!!!!!!!!!!!!!!!!!

This is utterly disgraceful to Moffat County & to the DA's office. This man endangers fellow officers, wastes hours & hours of valuable time & taxpayers money with drug cases, gives dealers info into police dealings, steals police computers, and gets a slap on the wrist????

This just confirms, this county is completely & utterly morally bankrupt & corrupted from the very top down.

dynamo7412, interesting how you bring up Mike Bailey. Does it even bother you that the CSP illegally obtained the Defandant's blood to check on the status of the driving condition of the driver of the vehicle? It had nothing to do with how "spineless" the DA's office is/was, it is against the CSP.

Before any officer takes the Law Enforcement Oath of Honor, it is important that he/she understands what it means. An oath is a solemn pledge someone makes when he/she sincerely intends to do what he/she says. Honor means that one's word is given as a guarantee. Betray is defined as breaking faith with the public trust. Badge is the symbol of your office. Integrity is being the same person in both private and public life. Character means the qualities that distinguish an individual. Public trust is a charge of duty imposed in faith toward those you serve. Courage is having the strength to withstand unethical pressure, fear or danger. Accountability means that you are answerable and responsible to your oath of office. Community is the jurisdiction and citizens served.

TOO BAD, this oath is ignored by many of our officials. And we are paying them to corrupt the system that most of us honor & respect.

I understand everyone wanted their pound of flesh. Lord knows I believe the Craig City Council completely and totally bungled their "review" of the IA job done by the upper tier of our police department. But, is it better for us all to move on knowing Ken totally disgraced himself and committed several crimes, or should we play out a long ordeal in the courts and newspaper until everyone is so sick of reading about it that the real point gets forgotten.

Ken Johnson is a dumb person. We all know this. Tausha Merwin is a dumb person. This is no shock. If they want to take up each other's time by themselves and the rabble that will share their company, good riddance. I want Walt Vanatta fired. Whether he had the best intentions or not, he was so arrogant he let himself be used and put his own officers in danger. If I worked over there, I would resent the hell out of that.

I have to agree with everyone's post. If any layperson in our community committed the same crime, they would be facing time in prison, not just a slap on the hand. Why is it that some members of the law enforcement or elected official think that they are above the law, when they are there to uphold the law? This is a disgrace to the community. As a community, we need to let everyone in our local government know that we will not tolerate this behavior any longer. We need to take control of what is happening here, and make changes that will benefit our community. We need officials that will work for the people of Craig, and the needs that we have, and not their own agenda.

I am new to the community but I have to say this is truly sad. As a sworn officer he should have been held to a higher standard and an example made of him. If local law enforcement can commit crimes such as this and only get a slap on the wrist what message does that sent to the law abiding citizens? It tells me that "Hey come to our county to commit your crimes, we don't care." If I were the judge I would refuse the plea agreement and make an example of this officer, and the county attorney's office! Somebody needs to stand up here and show the citizens of this county especially the new ones that criminal activity will not be tolerated here! Otherwise you leave the door wide open for criminals to move in and take control! Maybe that is the problem, could it be the county is run by a bunch of crooks? I am beginning to wonder.

I'm not trying to slam or anything but set things just a wee bit straight.

The Oath of Office is not what you wrote but is:

I, XXX, do solemnly swear(or affirm) that I will support the Constitution of the United States and the Constitution and the laws of the State of XXXXXX; that I bear true faith and allegiance to the same, and defend them against all enemies, foreign and domestic, and that I will faithfully and impartially discharge the duties of the office od Peace Officer according to the best of my ability, so help me God (or so I do affirm).

The Law Enforcement Oath of Honor you mention is usually posted somewhere in the building, for officers to see and think about, but it is not an oath taken when the officer is sworn in.

I know Ken and absolutely do not condone what he did. I think he is getting off with a slap on the wrist and he did violate his oath of office, just not the one you listed.

This whole sitauation is a complete disgrace. To our community, and to law enforcement in general. I mean, what has happened to this country? It is my understanding that police officers exist to make us all feel safe, and protected. The reality of things is that any time we see a cop we all cringe, and feel threatened. Plain and simple police SCARE us, they do not make us feel protected. This is a direct example of why that is. We have a corrupt police force (nationwide) who put on that uniform and think that they are invincible. And why wouldn't they? This situation has directly proven to us that police can do what they want- tamper with evidence, have sexual relations with their "clients," drive around the city of Denver armed and drunk (CSP Bagley), and completely disgrace the community only to recieve a slap on the wrist. Disgusting and pathedic. Is there anybody that still takes the police force seriously anymore? .....anyone at all? Didn't think so.

Oh, I think there are a lot of officers who take their job very seriously and hold themselves to a higher standard than non-law enforcement. However, like all other occupations, there are those who do not hold themselves accountable and get in trouble.

I am absolutely sure too that these same officers are applauding the fact that Johnson got caught and is no longer ever going to be in law enforcement again. I am certain that they too are not real happy about the plea bargain that he is getting...

Obviously you have a problem with all cops, but if you are going to list the wrong-doings of police officers then you should get your facts straight. The trooper who was arrested for driving drunk in the Denver area is named David Dolan, and he worked out of Colorado Springs. Trooper Bagley is stationed in Craig and has never been accused of any wrong-doing. The only reason I can think someone would cringe and feel threatened when they see a cop is if they did something wrong. I certainly don't have that reaction when I see a cop. I agree, there are bad cops, but there are corrupt people in every profession, ie. bad doctors, lawyers, auto mechanics, etc. It's ignorant to chastise all cops because of the wrong-doings of a few. By the way, I totally disagree with the sentence given to Ken Johnson. I think he should go to prison for the crimes he committed.

Oh, okay, sorry about the wrong name on my post (not sure where I got that from). Yes, it was CSP Dolan and that was a disgrace. And no, I do not have a problem with police officers in general. I know far more excellent police in this town than bad. However, when working with such responsibility and notoriety as police officers do, it is these horrid examples which compromise the image of the force in general.

I remember why CSP Bagley's name came into my mind when thinking of the drunken CSP in Denver: he was the one who pulled over that kid whose mother wrote a letter to the editor a few weeks ago. I apologize for the name mix-up. It was unintentional and I too have not heard any wrong-doing regarding this officer either. Sorry about that! (But not sorry for Trooper Dolan, what he did was wrong- plain and simple.)

This is a disgraceful plea bargain but a trial would have brought out so much more against various police officials and even the DA's office. It's called CYA. I agree the judge should not accept this plea and it should go to trial.

I saw this coming from the onset. I knew he wouldn't get punished. Come on folks, are you really surprised? Think of all the dirt that Johnson knows on lots of people in all the agencies.... He would've had to implicate alot of people, and no doubt he would've to save his own hide. The DA's office as well might've been implicated. It would've brought down the whole house! So they let him off easy so they could all keep their jobs. I agree that Vanetta should be fired, and Snow should be as well. "A benefit to the community" What a joke! I was certainly hoping that they would be able to clean house with this case but......... now I fear what other officers are going to do, knowing that they pretty much will get away with absolutely everything

My point is any oath taken by Law Enforcement should be held to a higher standard. And when they break the law they swore to protect they should be prosecuted like everyone else. sickandtired, I agree with you, I thought the same thing at first. But all the publicity and articles led me to believe that just maybeee the D.A. would follow through and do HIS job. I was wrong!

The affair between Johnson & Merwin should have been a top priority for the chief, he obviously knew about it. Must have been hard for the decent cops to sit back and watch while Johnson catered to Merwin a drug offender. Pretty Disgusting! I would bet Merwin will see no charges either SHE knows way too much.

The ONLY (benefit to the community) would be if the judge denied the plea, the D.A. actually did HIS job as a servant to the people of Moffat County & prosecuted this case. After all charges were filed & crimes were committed. Johnson & Merwin need to be treated like any other defendants. The citizen's of Moffat County should be Outraged!

(For what it's worth, & definitely off topic, but important, I, too know Officer Bagley and can honestly say he is not only one of the smartest men I have ever met & funny beyond words, but a very decent, police officer & before saying anything negative about him, I would really make sure to know all the facts first. FYI, don't bother trying to outsmart him on the highway....it's useless, he is scary smart. He would have made an awesome Prosecutor as well.)

After this horrible example of justice with Ken, I can't imagine what the truly decent officers like Trooper Bagley & any others might say or feel after this. It's a disgrace for our community, & also makes the rest of the city police officers look really bad (though some may not be) in the attempts to keep Ken silent.

Ok, To all you people living in your Glass Houses--lets see how many of you put step up to the plate and either run for Mr Vanette's and Mr. Snow's job or who will get involved in the process of improving the situation. I bet not a single one of you will. What is it, that causes people to go after people that are in the lime light, that may not be perfect, but make desisions that they feel is the best for all--not just for a vocal minority?? I doubt even if I had graduated from law school or a police academy that I would be qualified to take either position.My conscious would not allow me to lie to the taxpaying public of moffat county like those two do everyday in their jobs.

We soon forget what brought Johnsons case to light it was an investigation during the Terry Hankins Murder trial. Look at the contrast the DA offers Johnson two months and probation for three felonies. He cops a plea and gets two months and Hankins he was never offered a plea bargain a reduced sentence say reckless manslaughter for hilling his wife (in self defense) no he is serving a life sentence because they procsecuted him during a trial. And that trial is not over its under appeal. It was also unfair as how can he have got a fair trial with the adverse publicoity of the mock bomb scare. (no doubt contrived) so you see there is no justice in the justice system. I bet Merwin gets eight years in prison wanna bet!!

Good Morning Craig Residents, I like to speak on behalf of my daughter Tausha, All of you have no idea who this woman is or who she has become. I do! She was told by her father at age 5 she would never succeed, she was abused verbally and mentally. She has had a hard road and traveled a long way to become a fantastic beautiful young woman. Which one of you has no dirty laundry in your closets? Cast the first stone, I will supply the rocks. The Lord says I am your judge Wow you all better be careful. My daughter had an affair, I happen to know many of the public servents that appear so special so EVIL. My daughters name has been ruined slammed picked apart. All you mothers and fathers out there just think for one moment how it feels to see this happen to your child you have no idea! Yes my daughter may have made some mistakes, she is not perfect but boy she could sure load your supplies in the back of your trucks when you needed her or run lumber to your homes. She has feelings and you know whats really sad she has a little boy that can read and he can read everyone's comments and see how wonderful you all are, This little boy loves Jesus and loves Tausha. I Love Tausha and I am proud to say that, My daughter graduated high school. My daughter graduated drug court on her OWN!! went through drug rehab and graduated and is clean, I will stand in the streets and proclaim this is my daughter and I am pleased. She helped me while growing up. I thank her for all the years she was there for me when I needed her. and now I will be there for her all the way. None of you know her only what the paper puts out there. I am ashamed to say I ever lived there with the citizens who are pitiful. And Ken thank you for all the years as a good police officer. I wonder if anyone remembers when you may have helped them. I do! Tausha I am proud of you, no matter what mistakes you have made or what anyone thinks my beautiful little girl.

Wow! That is so messed up! I just hate it when parents like you defend your kids when you really shouldn't. You make it sound like she only made a couple of little mistakes. She made a ton of mistakes! And you kind of excuse her affair because alot of other 'evil' people are doing it. What? Does that make it ok? Or a little less bad? Try telling that to Johnsons wife, oh wait, she died! OOps. Try apologizing to Kathy Johnson for the pain your daughter caused her! And did you actually read all the investigating reports, especially the ones that read word for word your daughters nasty text messages to Ken? If you didn't, you really should. Now thats I daughter a person could really be proud of! And I don't think she actually graduated from drug court on 'her own' like you said. She had a lot of help from Ken! Maybe thats why your thanking him? Wow, again, that is so messed up!

Also MOM........instead of being more concerned about your grandson reading comments about his mom and how damaging some can be, you should be concerned about how the actions of your daughter and the way she lives her life is damaging and hurting him! If you're going to pull the crap that she did, then you better expect for people to talk about you! She gave everybody plenty to talk about. And are you aware that Ken helped Tausha to break the law and her probation by giving her info so she can pass, then turned around and supplied her with alcohol? So he could sleep with her? So what exactly are you thanking him for? Instead of making light of her crimes, you should just hope that she turns her life around, (after she does her time) and accept what she did and admit to yourself how shameful it all was. You all past the test and did just what I wanted you to do, Talk about me wonderful thank you! It does not bother me or change the way I feel. I thanked Ken for many years of arresting my daughter and getting her off the streets. I asked him years ago to help her by chasing her down and arresting her when she was using, She is now clean and drug free. I do not protect my children when they have done wrong nor hide the fact that peoples lives may have been effected by my daughters actions, I do however stand by my children and Love and support them when they need me no matter what the matter may be and if the town of Craig thinks I may be wrong then that's your problem not mine. My daughter lives with her mistakes every day and that's enough without anyone else having to slam her. My daughter had a good up bringing and her drug use never started until she became an adult. Her father that spoke poorly to her was killed in a head on truck accident. I left this man when my daughter was a child. I did not stand by and watch as he abused her I left him. There are people in Craig who know me and they would probably tell you that I am far from being spineless. It does not bother me or effect my life what you think of me I am pretty tough; God made me that way. A spineless person is one who post your comment to me as you did when you have no idea the life I have lived either; Shame on you!!! I will always stand beside all four of my children, not behind or in front of but by their side. That's what a mother does. I also prayed for Kathy Johnson when all this was going on and her family during their time of her loss. I have prayed for her children that God would ease their pain. That's all I have to say.

Proud Mother; I don’t think that you are a bad mother. Tausha has made her decisions, and that is why she is in the situation she is in now. However, you are a bad grandmother if you think that Tausha’s lifestyle warrants her having custody of her kid. The comments that everyone is posting is their opinion of Ken Johnson and Tausha. If the comments hurt, oh well, most of them are based on facts. I spent a while last night reading all of the transcripts from the investigation. I am disgusted by the reports of illegal activities your daughter and Ken were reportedly involved in. In the report, there were text messages from Ken and Tausha where they discussed “numerous criminal acts the two committed together and/or independently”. In addition, how was Ken helping her? Was it by supplying her with alcohol, or conducting the UA’s himself. Or, maybe it was the inappropriate behavior conducted by your daughter and Ken at the ACET offices. Regardless, it is great that you support your daughter, as someone should. On the other hand, please don’t hate the rest of us that think that your daughter and Ken Johnson should be put in prison for many years.

I have adopted and have been raising my grandson since age 4 months old. I am his legal mother. Thank you. I understand the peoples responses its ok, I have walked away from and had to show tough love to my daughter for years. I am not stupid in any way. I know what she has done and has not done in this case. You only know what the press puts out there. I wonder what all of the text messages from residents in Craig might read if we were to get into your personal life. Think about it for a moment, How many lovers are there in Craig come on. If she had an affair with the man at City market know one would even turn their heads, Its only because it was a police officer. How childish has this case become. My daughter did not have to disclose her private life to anyone. But now the whole state of Colorado knows. I feel that losing your private business, life. name. Job, friends, family and honor is enough! She has been sentenced already and so has Ken. I told my daughter someday I was going to speak out and now I have, Thank you to twin2175 your post was nice and I agreed with most of what your response stated. And to the Jerry Springer freak we now know what your all about how sad! Enjoying our pain, Its not only mine, Kens parents, Kathy's family and your going to stand before God Almighty someday. Im really laughing up the fact that you think your daughter by choice let us in on her private life....wishful thinkin' babe but that was compliments of a Warrant! and Yes maybe everyone would have turned their heads if your daughter had just been with one person in some affair or otherwise.....but that was far from the case, atop of being with multiple "people"...she also was breaking numberous laws in the process......I can go into details and quote some of my favorite text messages if you would like.....? But im sure your already aware of how scandalous and bluntly stupid your daughter and ken both are! Your circle talk and finger pointing and religious interjections are further continuations of your own remorse.....you most likely were a horrible parent and instead of taking the situation for the full factual truth, that being your daughter is a complete tramp and total criminal!!your trying to turn the blame away from the situation and onto everyone else...throwing out all of the "well what if it was you & what if's"......trying to gratify Kenny Boy for being some sort of Honest Man and Super Cop.....even playing the Jesus Card.....thats hot! i think if there is some Final Judgement, your ignorance will be a huge topic of discussion!

First of all, PROUDMOTHER....You are right to stand by your children and love them no matter what. Nobody should disagree with that cause that is what a parent is all about. But I do have to say that I feel you contradict yourself. You want to be there for your children an stand by them and yet you left your adopted son behind and took off to another state. So exactly how does that work? As for you being upset about Tausha's personal life being put in a spotlight, yes I can understand that that would be upsetting. Ken and Kathy were already seperated and in the process of a divorce when Tausha and Ken started having a relationship. So I agree that their "affair" should not be a topic of discussion! But you have to take into consideration that no one really would have known or even cared about that if it wasn't coupled with their illegal activities! And yes she has to live with her wrong doings but that doesn't mean that she shouldn't be punished or chastized. We're all human, we all make mistakes, and we all have to pay the consequenses! But we all also know right from wrong and have the ability to choose! Tausha made her choice and now she's going to have to live with the punishment and ridicule. God fearing or not, nobody is above the law.

Second of all...I will not completely disagree with PROUDMOTHER for thanking Ken Johnson. He has been there for me in many situations and helped me through some rough times. I considered him not just a police officer but a friend. There was a time when he was a good cop. He was loved and respected by all. What happened to that man? Don't know. Maybe he fell in love or tripped and hit his head really hard. Or maybe he tripped and hit his head and as a result he fell in love! Regardless, we all know that love can cause you to do things that are uncharacteristic. Does that excuse his actions? Definately not! Should he be punished for his crimes? Absolutely! Was he repremmanded severe enough? NO WAY! Any average joe would have gotten a fair amount of time in prison for the crimes he and Tausha committed. And Tausha probably will. And it's not right that she will do so while Ken is roaming free. And even though it saddens me that Ken Johnson is a "good cop gone bad", we can all take heart that he and Tausha Merwin will not plague our community like that again. If I were Ken, I would get the heck out of dodge as soon as the law will allow.

Were you at the airport when they passed out education at the train station? I hope and pray that the school you attended to learn punctuation, spelling, grammar, and capitalization is not receiving federal education funds. If it is, then I am one highly upset tax payer!

The most fascinating part of the above comment is ". . . I'm not the best speller or always grammatically correct[ ]". Really? You're not the "best" speller, or "always" grammatically correct? How about the worst speller and nearly always grammatically incorrect? For starters, proper nouns (Craig, Colorado) are always capitalized, as is the personal pronoun I. Looks like you have a handle on adverbs (pathetically, grammatically), although you can spell neither.

Where on earth did you go to middle school, and how long have you been speaking/writing English?? I doubt whether anyone is making fun of you; instead, it is simply very sad that your writing passes for English by an an adult. No wonder the Chinese will be the next world power, and this will probably occur some time between 2012 and 2014. The Chinese actually do speak and write English, in addition to Chinese and other major world languages... French, German, Arabic... The American educational system has become sad, sad, sad, and an embarrassment to Americans.

Greystone, you may be right, but usually people who have studied English as a Second Language in a TESL/TEFL-type program actually speak and write much more properly than native American speakers. They also usually understand grammar and punctuation rules much better than our own American school children, because our English class expectations of our own children are so lax.

Instead, this guy reads like someone who grew up speaking English, but who has never progressed beyond 2nd grade in his grammar and punctuation and spelling and complexity/variety of sentence structure. He also may be a high school drop-out who did not think core classes were of any importance when he was in school, and who therefore did not pay much attention when his teachers presented good lessons and practice assignments for him.

And still we wonder why the Chinese are taking over.....

I agree with you 100 percent!! I was appalled when I read the comment by toomuchtime, as were my children, who range in age from nine to fifteen. You cannot get your point across, if you cannot communicate properly. You don't have to be the best speller, or the most grammatically correct, however you do have to speak proper English if you want people to understand you. This guy/gal not only misspelled many of the words, but used absolutely no punctuation at all!! Sadly, there are many adults in our society who lack basic English writing skills. I am not trying to be rude, but merely pointing out the obvious. If you won't learn to write properly, at least use spell check!!

Nine (9) comments have been deleted on this post due to what the CDP is calling Agreement Violations. Really? Has the Agreement really been violated by every one of these commenters, or do we just have a few overly sensitive folks in the community who cannot stand to read the truth about themselves? This is not the only thread on which this has occurred.

I understand that there are those who live among us who would complain and whine about every little ol' thing. I do not understand that a newspaper, champion of the 1st Amendment Freedom of the Press, would bow to such pressure.

For the record, I have flagged more than one of the comments posted by Onewhocares, but the CDP has never removed one that I have flagged. I do not threaten or bully or claim that I will sue, so that is probably why the comments I flag are not ever removed. That's okay. I would be ashamed of myself if I had to make empty, baseless threats to get my way, so I would much rather be ignored by the CDP.

C'mon, Craig residents, stop whining and grow up.

C'mon, Craig Daily Press, stand up to the pressure of bullies. To bow to them is to allow the bullies to control you.

On a lighter note, I am going to start reading the CDP at midnight so that I can see all of the so-called offensive comments before they are scrubbed by the Moderator. lolol That should be so much more entertaining than reading the sanitized version later the following day. lolol

Toomuchtime.....I don't care about your grammatical and spelling errors. What gets me is that you're a hypocrit. You're ticked off cause you think we're bashing others and yet you come on here doing the same to us. Everybody is entitled to their own opinion. I also gather from your comments that you're not from Craig. If thats the case then our discussions about the messed up stuff going on in our community doesn't really concern you now does it? You have no idea about the impact this event has had on our little town. Those of us who speak out have read the incident reports on this monstrosity, we didn't just get our info from the paper. So maybe you should catch up on it before you judge us for our opinions. Someone who has no clue about the situation has no right to speak out about it.

to patriot,,,office talk between our so called jeremy snow and other participants of our lovely court ,,,,,,mostly what is not so strange is they,,,the jail workers already know 99 percent of the sentence before it gets to trial,,,alot and mostly all of these ken baby johnson stories has been sent to state and federal offices
