Notice of Proposed Decision
The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Approve Bond Release Application No. 8 (SL-8) for the Trapper Mine, Permit No. C-1981-010. The mine is operated by Trapper Mining, Inc. under the provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The bond release application was submitted by Trapper Mining, Inc. on August 6, 2008. Trapper Mine is requesting a Phase l Bond Release of 476.6 acres of land. These lands were reclaimed between 2003 and 2007. The bond release included all lands that have been regraded, with drainage reheld is sought with the bond release application. The affected area is located in Moffat County, approximately 6 miles Southwest of Craig, Colorado.
Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the Moffat County Clerk and Recorder.
Any person who has an interest which is or may be adversely affected may request an adjudicatory hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty (30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for the request and objections to the proposed decision.

ORDINANCE NO. 985 (2008)
AN ORDINANCE ADOPTING NEW COLLECTION FEES
FOR
RESIDENTIAL AND COMMERCIAL REFUSE COLLECTION
Whereas the City of Craig provides residential and commercial refuse collection services and has previously established fee schedules for such services; and
Whereas Moffat County, which operates the landfill used by the City of Craig refuse operation, has raised the landfill rates for all users of the landfill, including the City refuse; and
Whereas the City must adopt rate increases to absorb these expenses.
NOW THEREFORE, BE IT ORDAINED BY THE CITY OF COUNCIL FOR THE CITY OF CRAIG, COLORADO:
Section 1
. Section 8.04.250 of the Craig Municipal Code entitled "Refuse Collection Fee" shall be amended to state to follows:
8.04.250 Refuse Collection Fee.
The following fees shall be charged by the City monthly for refuse collection service and are payable on or before the first day of the following month:
A. Residential Household Rate. The monthly fee for each household shall be eleven dollars ($11.00) for collections. Landfill costs for disposal of refuse shall be six

dollars ($6.00) (
$9.00)
per household monthly. Any extra pick-up for residential customers shall cost $5.00 per pick-up. Any passenger tires left for pick-up will be charged a disposal fee of five dollars ($5.00) for each tire. The residential rate schedule shall become effective on August
January 1, 2008
.
B. The monthly fees shall be based upon the attached table, entitled "New Dumpster Rates With Landfill Fees Included, Effective August
January 1, 2008.
" The fee for collection of furniture and household appliances shall be fifteen dollars ($15.00) each, except that for any appliance containing refrigerant which has not been properly removed by an EPA-approved technician as evidenced by a properly affixed sticker, the fee shall be fifty dollars ($50.00).
1. Extra pickups for dumpsters shall be ten dollars ($10.00) for a two-yard dumpster, twelve dollars ($12.00) for a three-yard dumpster, fifteen dollars ($15.00) for a four-yard dumpster, twenty-five dollars ($25.00) for a six-yard dumpster, and thirty dollars ($30.00) for an eight-yard dumpster.
2. Cartons, boxes, crates, and other refuse which cannot be conveniently deposited in the containers herein provided for or which cannot be treated and handled as other garbage and refuse with the available equipment shall be subject to a special charge to be determined and assessed according to the particular circumstances.
3. Rates for rubbish and garbage collection under a manual collection system shall be converted to comparable household rates. The fee schedule as listed in this section shall become effective on August
January 1, 2008
. Nothing in this Ordinance shall prohibit the City from collecting refuse and garbage from customers outside the city limits of the City of Craig.
4. Temporary construction dumpsters may be provided for normal construction debris at the rate of thirty-two f

per pick-up for a two-yard or three-yard dumpsters, forty-three

dollars ($43.00) ($50.00) for four-yard or six-yard dumpsters, and eighty

dollars ($80.00) ($90.00) for shingles (four-yard dumpsters only). For unusual construction debris, the rates may be determined by the City according to weight.
C. A fifteen percent (15%) reduction in the amount charged for refuse service shall be available to those commercial customers who sign an agreement for municipal refuse service for a period of twelve (12) months. The discount shall apply only to dumpster rates and is reflected in the table above.
Section 2.
Health and Safety.
The City Council of the City of Craig hereby finds for, declares and determines that this Ordinance is necessary for the preservation of public peace, health, and safety.
Section 3.
Publication and Summary.
The City Council deems it appropriate to publish the title of this ordinance, together with a summary of the ordinance and with a statement that the text is available for public inspection and acquisition in the Office of the City Clerk.

ORDINANCE NO. 986 (2008)
AN ORDINANCE AMENDING SECTIONS 13.48.010 AND 13.16.010 OF THE CRAIG MUNICIPAL CODE TO INCREASE THE WATER AND WASTEWATER RATES TO PROVIDE SUFFICIENT REVENUES TO MAINTAIN THE BALANCE OF WATER AND WASTEWATER ENTERPRISE FUNDS.
WHEREAS, the City Council has determined that an incremental increase in user fees for the water and wastewater enterprises is necessary in order to keep up with inflationary pressures and to maintain the health of the enterprise funds;
WHEREAS, the proposed fee increase would result in a one dollar increase to the water monthly fee, a ten-cent increase per thousand gallons of water consumption, and a one dollar and twenty-cent increase in the wastewater monthly fee;
AND WHEREAS, the City Council determines that it is in the best interest of the City of Craig and necessary for the preservation of the general welfare of the people of the City of Craig to maintain the health of the Water and Wastewater enterprise funds.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF CRAIG, COLORADO:
Section 1
. Water Rate Schedule. Section13.48.010 of the Craig Municipal Code is hereby amended as follows:
A. The following water rates shall be charged by the city and are payable on or before the twentieth day of each month. These fees shall be assessed for each residential dwelling unit with service and each commercial or industrial unit with service.
1. Within the corporate limits of the city: $17.60

The following sewer rentals shall be charged by the city and are payable on or before the twentieth day of each month. The rentals shall be charged for the use of the sanitary sewer system of the city and for all property or premises connected therewith.
1. Residential Units. Each residential unit shall pay $16.50

per month. Each individual apartment and trailer shall be considered a single residential unit.
2. Commercial Business. Commercial structures shall pay ($16.50)

The City Council deems it appropriate to publish the title of this ordinance, together with a summary of the ordinance and with a statement that the text is available for public inspection and acquisition in the office of the City Clerk.
Section 5
. This ordinance shall be effective immediately upon passage.
Section 6.
This Ordinance is enacted pursuant to the City's authority to act under its police power to protect and preserve the general warfare of the City and its citizens.
